Conditions of Use

I. General issues

  1. The owner of the children's shop, hereinafter referred to as the seller, is Dino , 93-036 Łódź, Piotra Skargi 12 street, Poland, NIP 725-000-32-04, Regon 470873936.
  2. We ship baby products to any location in Europe - Shipping prices.
  3. Free delivery for orders over 4000 pln (about 900 euro) in all European countries. Enter "free delivery" in the order comments. Not valid for furniture shipping.
  4. Each product purchased is accompanied by a receipt or an invoice with VAT shown.
  5. The seller undertakes to use the personal data provided by the customer only for the purposes necessary for the sale, the complaints procedure or the return of the goods.
  6. Issues that are not covered by these regulations are governed by the Consumer Rights Act. (Ustawa o prawach konsumenta) of 30 May 2014 poz regulated. 827 and Civil Code (Kodeks cywilny).
  7. In the event of doubts or ambiguities of interpretation, the provisions of the legal acts referred to in the previous sentence shall always take precedence and apply to the seller. 
  8. In the case described in the previous point, the customer always has the right to choose the option that is more favourable for him.

  10. Discounts from different sources do not add up. If two or more types of discount apply, only the one that is most favourable to the customer, the highest discount, is used for the final calculation of the sales price.

II. Orders

  1. Automatically via the customer's shopping basket
  2. Via the order form without logging in - you do not need to log in and enter your password.
  3.  By e-mail to the following address: zamow@dino.sklep.pl (note product codes).  
  4.  By telephone, stating the order and dispatch details of our advisor. We save this order and send it to the customer for confirmation.
  5. After receipt of each order, we send a confirmation to the customer's e-mail address. In the e-mail we confirm the exact shipping costs and the approximate time of delivery of the goods to the customer.
  6.  We respond to orders by e-mail without delay.
  7. Pursuant to Articles 84 and 88 of the Civil Code (Kodeks cywilny), the Seller reserves the right to withdraw from the contract if obvious, clearly erroneous prices of goods on the Store's website are caused by unintentional editorial or IT material errors (within the meaning of Article 84 of the Civil Code). In this case, the customer will be informed in writing within 7 days. 
  8. Similarly, on the basis of Articles 84 and 88 of the Civil Code, the seller reserves the right to withdraw from the contract if the price of the goods on the shop's website has to be changed due to an unexpectedly large price increase at the retailer, which was not known to the seller at the time the offer was introduced in the shop. In this case, the seller undertakes to sell the goods in question to the customer at the purchase price, i.e. without profit, with a zero margin. The customer will be informed immediately - within 14 days - in writing or by e-mail, and the seller will provide him with a copy of the proof of purchase for the goods in question upon request
  9. The waiting time for delivery is 3 working days if the goods are in our warehouse at the time of ordering.     
  10. If the product is not in stock at the time of the order, we will inform the customer immediately of the delivery date.
  11. For international purchases, the approximate delivery date, if the goods are in our warehouse at the time of ordering, is indicated in the price list for international shipping.

III. Payment options

  1. Quick online payments: Przelewy24 - card, fast bank transfer, Blik, Google Pay - no additional costs.
  2. Bank transfer - advance payment to our bank account - the order number or your e-mail address must be stated in the payment title (for orders by e-mail). 
  3. Cash on delivery payment - COD - is possible in the following countries: Poland, Germany, Lithuania, Latvia, Estonia, Czech Republic, Slovakia, Hungary, Romania, Bulgaria, Croatia, Slovenia, Greece.
  4. Additional handling fee is required for COD payment. In Poland: 19 PLN, in other countries: 49 PLN. For COD payments, we charge a 10% deposit to cover delivery costs if the customer does not collect the goods (except Poland).
  5. Cash or card - at the company's head office.  
  6. For hire purchase - eRaty Santander (only in Poland). Additional handling fee 19 PLN.
  7. The prices in the shop are shown in the following currencies: PLN Polish zloty, EURO, USD US dollar, GBP British pound, CHF Swiss franc, CZK Czech koruna, HUF Hungarian forint, RON Romanian leu, BGN Bulgarian lev, DKK Danish krone, SEK Swedish krona, NOK Norwegian krone.
  8. The customer can pay in the following currencies without having to exchange them at the bank: PLN Polish zloty, EURO, USD US dollar, GBP British pound, CHF Swiss franc, CZK Czech koruna, HUF Hungarian forint, RON Romanian leu, BGN Bulgarian lev, DKK Danish krone, SEK Swedish krona, NOK Norwegian krone.
  9. Prices in GBP are only valid for delivery in the UK. The customer is obliged to pay the border sales tax.
  10. The minimum order value for the UK is £140 GBP

IV. Returns and complaints

Returns

Any customer can abandon purchased goods without giving any reason within 60 days of receiving the package.
       The prerequisite for returning the goods is that a declaration of withdrawal must be sent to the seller within 60 days from the day on which you came into possession of the item or on which a third party other than the carrier and specified by you came into possession is presented of the article.
      Taking back and returning goods is not possible if: (Art. 38 Consumer Law)

     a. The contract was fully executed before the end of the cancellation period if the customer expressly agreed to such a measure before the start of the service.
     b. The price of the product/service is variable (depending on fluctuations in the financial market) and is not under the control of the seller.
     c. The products ordered were manufactured according to the customer's individual guidelines to meet their needs.
     d. Products have a short shelf life and/or deteriorate quickly,
     e. The products are in sealed packaging, which cannot be opened for health and/or hygienic reasons, e.g. mattresses, breast pumps, etc.
     f. selected products are inextricably linked to other products,
     G. The order concerns alcoholic beverages, the delivery of which is at least 30 days after placing the order and whose price depends on market fluctuations over which the seller has no influence,
     H. ordered computer programs, sound/image recordings were in sealed packaging that was opened by the customer,
     i. The order affects newspapers and magazines, but not subscriptions.
     j. The conclusion of the contract concerns the booking of a good or/and service (e.g. apartment/car rental, tickets for entertainment events).
     k. The contract applies to digital content that is not provided on a tangible medium and the transmission of which took place before the expiry of the withdrawal period, following the express consent of the consumer and prior information to the customer about the loss of the right of withdrawal.

The possibility of returning the goods within 60 days does not apply to the refusal to accept the ordered goods when delivered by courier.
In this case, the general rules for returns apply in accordance with the Consumer Code and the provisions of the Civil Code on the fulfillment of obligations arising from mutual agreements.
In the event of an unjustified refusal to collect the goods delivered to the customer in accordance with the contract, the buyer is obliged to reimburse all costs incurred by the seller.
This means: costs for the preparation and packaging of the goods, the full service of the order, the delivery of the goods to the customer, the return of the goods to the seller and other costs associated with the execution of the order. For a standard package with a pack up to 30 kg, this total cost is PLN 80.00. If there are more packages, the specified quantity increases proportionally.
The consumer must return the item to the entrepreneur or hand it over to a person authorized by him no later than 14 days after the day on which he canceled the contract.
  If possible, please send the receipt received at the time of purchase or the VAT invoice number with the returned goods in order to issue a correction invoice.
  The consumer bears financial responsibility for any diminished value of an item if it is used in a manner beyond what is necessary to establish the nature, characteristics and functioning of the item.
   Any returned product must be packaged in a box. When transporting heavy goods, especially furniture, there is a high risk of damage or loss during transport. Therefore, it is necessary to pack them as carefully as possible before returning them.
If the duty of care is not observed when packing the goods, the customer bears financial responsibility for any damage or defects that arise during the return transport - in accordance with Article 34 § 4 of the Consumer Rights Act of May 30, 2014 point 827 in accordance with Articles 415 and 548 § 1 of the Civil Code Code in accordance with Articles 41 and 72 of the Traffic Act.
The money for the goods and the delivery of the goods to the customer will be returned immediately, no later than 14 days after the customer's withdrawal from the contract, by bank transfer or if the account number is not specified by postal order to the customer's address. The bank account number required for a refund to our customers can be sent to the seller's address by email or registered mail.
    The costs of returning the goods by the customer are not financed by the seller, which means that the consumer bears the direct costs of returning the item.

Complaints

    The seller is obliged to deliver the goods free of defects.
     We offer a 2-year guarantee on all purchased goods.
    We process complaints immediately within 14 days. Detailed rules for the complaint procedure here.
     The consumer has the right to out-of-court processing and redress of complaints through the establishment of the City Consumer Commissioner - ul. Piotrkowska 113, 90-430 Łódź, email: mrk@uml.lodz.pl
   The seller is not bound by the code of conduct because he believes that not simple words and declarations, but real actions are a measure of the entrepreneur's ethical behavior.

V. Shipping conditions

  1. Every parcel we send can be tracked and determine what happens to it during shipping.
  2. All you have to do is go to the GLS, Schenker, Raben, Rhenus or DPD website and enter (preferably via the clipboard) the parcel consignment note number we sent you by e-mail.
  3. We deliver goods with the courier companies GLS, DPD, Schenker, Raben, Rhenus and DHL. We also ship goods abroad. Here is a detailed price list for international shipping.
  4. Please check the condition and appearance of the parcels received by the courier to determine if there is any visible damage that may occur during transport.
  5. If the damage is visible, a checkout report must be drawn up with the courier on the day of delivery.
  6. Please check the contents of the parcel you have received, even if the box is undamaged. If any damage is found inside, a courier should be called immediately and a damage report written. At the latest, however, within 6 days from the date of delivery of the parcel.

VI. Delivery costs

  1. Shipping prices

  3. Heavy and large furniture parcels or vehicles must be shipped on a pallet - prices in the table.   
  4. All shipments are insured.
  5. Free shipping for all goods within Poland. This does not apply to heavy and bulky furniture parcels, vehicles and shipments on a pallet.
  6. For single packages over 30 kg or pallets, the shipping costs only include delivery to the "first customer door".
  7. This means that the service does not include bringing goods of this weight to the upper floors. This follows directly from the provisions of the Transport Act and the regulations of the courier companies.
